These Terms of Sale govern all pre-orders placed for the Vertiflier Air aircraft via the website operated by Vertiflier OÜ, a company registered in Estonia. By placing a pre-order, you agree to these Terms.

1. Pre-Order and Down Payment

By placing a pre-order, you agree to pay a refundable down payment to reserve a Vertiflier Air aircraft. The estimated delivery time will be stated in the order confirmation email you receive after placing your order.

Your down payment is refundable only if the aircraft is not ready for delivery (at factory) within 12 months after the estimated delivery date provided by Vertiflier at the time of your pre-order.

Applicable taxes and government fees are not included in the Price and will be determined at the time of aircraft delivery, based on the Client’s location and regulatory requirements. The Client will be responsible for paying any such taxes or fees prior to or at the time of delivery.

2. Development Status and Design Changes

Vertiflier Air is currently under development. While Vertiflier aims to deliver the aircraft as presented, design specifications, features, and technical parameters are subject to change as part of ongoing improvement.

  • Minor changes do not entitle the client to withdraw or receive a refund.
  • Major changes that significantly deviate from the originally presented design will be communicated to the client. In such a case, the client may withdraw from the contract and receive a full refund of their down payment.

3. Certification and Regulatory Responsibility

Vertiflier Air is designed to comply with FAA Part 103 Ultralight Vehicle regulations in the United States. As of the date of ordering, this category does not require certification or licensing. However:

  • Should regulatory requirements change between the time of order and delivery, Vertiflier will not assume responsibility for any new certification or licensing obligations.
  • It is the client’s sole responsibility to ensure compliance with all applicable regulations in their jurisdiction, including operational and registration requirements.

Clients outside the U.S. should contact Vertiflier for guidance regarding their local regulations.

4. Operation and Usage

By purchasing the Vertiflier Air, the client fully and unconditionally agrees that:

  • They are responsible for the proper and lawful operation of the aircraft in accordance with all applicable laws, regulations, and manufacturer guidelines.
  • Vertiflier is not liable for misuse, improper maintenance, or operation of the aircraft.

FAA Part 103 Eligibility

The Vertiflier Air is designed to fall under the FAA Part 103 Ultralight Vehicle category in the United States. Under current regulations:

  • No pilot’s license, medical certificate, or aircraft registration is required.
  • There is no FAA-mandated minimum age for operating an ultralight; however, Vertiflier recommends that pilots be at least 18 years old or operate under the supervision and responsibility of a legal guardian.
  • The aircraft must be flown solely for sport or recreational purposes, during daylight hours, and in uncontrolled (Class G) airspace, unless prior authorization is obtained.
  • The aircraft may be operated by only one person at a time (single-seat only).

It is the client’s responsibility to ensure legal and safe operation according to FAA regulations and local laws.

5. Warranty

All Vertiflier Air aircraft and their included components are covered by a one-year standard limited warranty from the date of delivery.

This warranty excludes wear items, including but not limited to:

  • Propellers
  • Joysticks
  • Motor bearings

Full warranty terms will be provided upon delivery.

6. Governing Law

These Terms of Sale are governed by the laws of the Republic of Estonia. Any disputes shall be resolved in Estonian courts.

7. Acceptance of Terms

By placing a pre-order, the client acknowledges and agrees to all of the terms and conditions set forth in this document.
